TERMS & CONDITIONS - RISE
Welcome to RISE (“we”, “us”, “our”). These Terms & Conditions (“Terms”) govern your use of the RISE mobile application, website, content, programs, and services (the “Services”).
By accessing or using RISE, you agree to these Terms. If you do not agree, you should not use the Services.
1. Our Services
RISE provides digital content and experiences including meditation, journaling, mindset education, courses, and community features designed for personal development and wellbeing.
We may update, modify, or improve the Services from time to time.
2. Eligibility
You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use RISE. If you are under 18, you must have permission from a parent or legal guardian.
3. Accounts
To access certain features, you may need to create an account.
You are responsible for:
- Maintaining the confidentiality of your login details
- All activity under your account
- Acting considerate to RISE community and all members
We may suspend or terminate accounts that breach these Terms.
4. Subscriptions & Payments
RISE offers paid subscriptions for access to premium content and features.
4.1 Third-Party Billing (Apple App Store)
If you purchase a subscription through a third-party platform such as Apple, your payment, billing, cancellation, and refunds are processed by that platform and are subject to its terms (for example, Apple Media Services Terms).
We do not directly control billing for subscriptions purchased via third-party platforms and cannot handle any refunds with an IOS plan.
4.2 Automatic Renewal
Subscriptions automatically renew at the end of each billing period unless cancelled by you before the renewal date.
It is your responsibility to manage your subscription settings through the platform where you purchased it.
4.3 Pricing
We may update pricing or subscription structures from time to time.
Where pricing changes affect existing subscribers and require action (for example, switching plans on a third-party platform like IOS), we will provide reasonable notice where practicable. Some legacy pricing may remain active unless users choose to change or cancel their subscription.
5. Subscription Changes & User Action
From time to time, we may update subscription plans, features, or pricing.
In some cases, especially where subscriptions are managed through third-party platforms, users may need to take action (such as switching plans manually) to access updated pricing or offerings.
We will make reasonable efforts to notify users of required changes, but we cannot modify third-party subscriptions on your behalf.
6. Cancellations
You may cancel your subscription at any time through the platform where you purchased it (for example, the Apple App Store).
Cancellation will take effect at the end of your current billing cycle unless otherwise stated.
7. Refunds
All fees are generally non-refundable except where required by the Australian Consumer Law or other applicable legislation.
Under Australian Consumer Law, you may be entitled to a remedy (such as a refund or replacement) for services that are faulty, not as described, or fail to meet consumer guarantees.
8. Intellectual Property
All content within RISE (including meditations, audio, video, text, graphics, branding, and materials) is owned by or licensed to RISE.
You agree not to:
- Copy, reproduce, or redistribute content without permission
- Share your account with others
- Use content for commercial purposes without written consent
9. User Conduct
You agree not to:
- Use the Services for unlawful purposes
- Interfere with or disrupt the platform
- Post harmful, abusive, or inappropriate content in community spaces
We may remove access for users who breach these Terms.
10. Health Disclaimer
RISE provides educational and wellbeing content only.
It is not medical, psychological, or professional advice and should not be relied on as such.
If you are experiencing mental health concerns, you should seek support from a qualified healthcare professional.
11. Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential loss arising from your use of the Services.
Nothing in these Terms excludes or limits your rights under the Australian Consumer Law.
12. Third-Party Platforms
Where you access RISE through third-party platforms (such as Apple), those platforms are responsible for their own systems, policies, and billing processes.
We are not responsible for the actions or performance of those platforms.
13. Changes to These Terms
We may update these Terms from time to time. Continued use of RISE after changes indicates acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the jurisdiction of the courts of Victoria.
